Bannister Law has commenced the First Class Action under Australian Consumer Law against Volkswagen Group Australia Pty Ltd (ACN 093117876) and Audi Australia Pty Ltd (ACN 077092776) in the Federal Court of Australia on 30th October 2015.
The action is for the class of all effect owners of the Volkswagen, Skoda and Audi diesel vehicles with the 1.6L & 2.0L EA 189 engines. You are part of the class if you bought one of the effected models made between 2008 and 2015 and still have the vehicle, you may be entitled to compensation.
VW has confirmed that the defeat devices were fitted in diesel vehicles manufactured between 2008 and 2014, and subsequently sold in Australia. Volkswagen has since announced the recall of more than 90,000 VW and Audi vehicles sold in Australia in this period.
It remains unclear how VW will rectify the problem with ‘defeat devices’ and how this may impact affected vehicles.
